Senior Director, Head of Litigation & Risk Management San Mateo Cambridge BeiGene continues to grow at a rapid pace with challenging and exciting opportunities for experienced professionals. The Senior Director, Head of Litigation & Risk Management will be a key member of the Legal & Compliance team, responsible for protecting BeiGene's interests by leading the management of litigation, investigations and disputes involving the Company, and developing and managing an Enterprise Risk Management (ERM) program. Reporting to the Assistant General Counsel, Chief Compliance Officer, this position will work on a wide range of matters, including corporate, commercial, IP, securities, employment, products liability, and other forms of litigation and pre-dispute resolution. This position will work with outside counsel, internal clients and members of the Legal and Compliance team, collaborating with all parties to develop successful strategies and resolutions. This position will also create and support BeiGene's ERM program, and work with Legal and Compliance team members as well as cross-functionally with internal clients to manage and report on enterprise-level risk across the organization. Responsibilities: Litigation and Dispute Resolution Provides strategic counseling related to potential and actual disputes to the General Counsel, business units, and senior executives. Manages and advises on parties' obligations, performance and remedies under business collaborations, vendor agreements, and other contracts. Manages and drives global strategy on litigation, arbitration, and disputes, including corporate, commercial, IP, securities, employment, product liability, competition, and government investigations. Participates in key proceedings as needed, including depositions, hearings, mediations, arbitrations, settlement conferences and trials. Manages and works closely with Legal and Compliance, Human Resources, and other functions on internal investigations. Manages litigation / arbitration budgets, outside counsel and related vendors effectively and efficiently. Works cross-functionally with IT, other key stakeholders and the business in general to ensure compliance with litigation-related obligations, including document holds, discovery and responses to subpoenas. Negotiates and drafts dispute resolution provisions in contracts, settlement agreements, and releases. Builds and implements BeiGene's Enterprise Risk Management (ERM) program to support the identification, assessment, management, mitigation and monitoring of enterprise-wide risks. Provides ERM guidance and training to internal clients. Tracks and advises on ERM issues, industry trends and best practices. Establishes required ERM processes and systems. Provides periodic assessments and reporting to senior executives and the Board of Directors. Advises on insurance programs and policies and self-insurance programs. Skills and Qualifications: A Juris Doctor from a nationally recognized law school. 10 - 15 years of litigation and dispute resolution experience, including experience representing pharmaceutical companies on a wide range of matters. Prior in-house experience preferred. Demonstrated record of successfully managing litigation and disputes and bringing to resolution. Exemplary leadership skills and ability to work effectively across a global organization. Excellent communication, analytical, organization, problem-solving and negotiation skills. Experience with risk management, including ERM assessments and reporting. Strong aptitude and interest in oncology and other pharmaceutical products. Ability to effectively manage and serve a wide range of client groups, including senior executives. Ability to present summary reports and live presentations to senior executives and the Board of Directors. Ability to be flexible and excel in a fast-paced, multi-project environment.
